Terms of Use for Companies
Last updated: 2025. FlexWork – Company registration and use of the platform in Japan.
These terms apply specifically to company registration and use of the platform by businesses that wish to post job openings and hire temporary workers through FlexWork, in compliance with the laws in force in Japan.
1. Acceptance
By registering your company or using FlexWork’s services as a hiring company, you confirm that you have read, understood, and agree to these Terms of Use for Companies.
2. Description of Service (Companies)
FlexWork provides companies with the ability to register, post temporary or short-term job openings, and connect with workers in Japan. The service includes company profile management, job posting and management, application management, and where applicable payment and support features, in compliance with applicable Japanese labour and employment laws (including, among others, the Labour Standards Act (Rōdō Kijun Hō) and the Employment Security Act (Shokugyō Antei Hō)).
3. Registration and Verification
The company must provide true and up-to-date information when registering, including company name, corporate registration number (法人番号), business type, legal representative, address, and other requested data. The company is responsible for keeping its password confidential and for all activity under its account. FlexWork reserves the right to verify the information provided and to refuse or suspend registrations that do not meet requirements or the law.
4. Company Obligations
The company agrees to: (a) comply with all Japanese laws and regulations applicable to hiring and employment, including payment of wages, working hours, and occupational health and safety; (b) not discriminate against candidates or workers on the basis of origin, gender, nationality, or other grounds prohibited by law; (c) provide working conditions consistent with the offers published on the platform; (d) process personal data of candidates and workers in accordance with the Act on the Protection of Personal Information of Japan (APPI) and other applicable rules.
5. Prohibited Use
The company may not use the platform for illegal purposes, provide false data, infringe the rights of workers or third parties, or use the service in a way that harms FlexWork or other users. In case of violation, FlexWork may suspend or terminate the registration and access to the services.
6. Fees, Payments and Contractual Responsibility
Use of fee-based or payment-related features is subject to the terms and rules disclosed on the platform. The contractual and employment relationship between the company and the worker is the sole responsibility of the parties. FlexWork acts as the platform intermediary and is not the employer of the workers referred. The company must ensure that all payments and labour and social security obligations are fulfilled in accordance with Japanese law.
7. Limitation of Liability
To the extent permitted by applicable law, FlexWork is not liable for indirect damages, lost profits, or losses arising from the use of the platform or the relationship between company and worker. FlexWork’s liability in relation to the service provided to the company shall be limited to what is set out in contract or law.
8. Governing Law and Jurisdiction
These terms are governed by the laws of Japan. Any dispute relating to these terms or to the use of the service by companies shall be submitted to the competent courts in Japan, unless otherwise provided by law.
9. Changes and Contact
